For companies hiring in Vietnam, calculating social insurance contributions starts with a key question: which salary components should be included in the calculation?
The answer is not always the same as an employee’s gross pay, take-home pay or the basic salary shown in an internal payroll system.
Under Vietnam’s Law on Social Insurance No. 41/2024/QH15 and Decree No. 158/2025/ND-CP, the contribution salary base is determined by specific legal criteria.
Here is what foreign employers should understand.
For employees whose salaries are determined by their employers, Article 7 of Decree No. 158/2025/ND-CP identifies three main components:
Not every payment automatically belongs in the contribution base. The legal criteria and the nature of the payment determine its treatment.
A payroll system may display several different figures, including basic salary, gross pay and the salary used to calculate social insurance contributions.
These figures serve different purposes and should not automatically be treated as interchangeable.
For example, if an employee receives an agreed job salary and an additional payment, the employer needs to assess the additional payment under the applicable legal criteria before determining the contribution base.
The key is to follow the legal definition, not simply the label assigned to a payment.
Employers can trace the calculation through three steps:
Review the employment contract to identify the job or position salary and relevant additional compensation terms.
Determine which components meet the criteria under Article 7 of Decree No. 158/2025/ND-CP. Do not assume that every payment is included or excluded based only on its name.
Check that the salary base used for social insurance calculations can be explained by reference to the agreed compensation terms and the applicable legal rules.
If the records do not explain how the figure was determined, the discrepancy should be reviewed rather than carried forward automatically.
When setting up payroll in Vietnam, foreign companies should avoid transferring salary classifications from another country without checking how Vietnamese rules apply.
Keep these distinctions in mind:
A clear and consistent method helps the payroll team explain how the contribution figure was determined and review it when compensation arrangements change.
Before applying a social insurance contribution rate, employers need to establish the correct salary base.
Vietnam’s Law on Social Insurance No. 41/2024/QH15 and Article 7 of Decree No. 158/2025/ND-CP provide the legal framework for that assessment. The specific treatment depends on the applicable rules and the employee’s circumstances.
